By accessing and using the ISPA Zero Rating Portal, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this portal.

These terms govern your use of the portal, including submission of zero-rating applications and related services. ISPA may update these terms from time to time without notice.

Portal Purpose & Scope

Primary Purpose

The portal serves to facilitate zero-rating applications in accordance with ICASA Notice 2450 of 2024 and spectrum licence obligations. It is not a general-purpose website hosting or development service.

Service Limitations

The portal specifically handles zero-rating applications for eligible websites. ISPA reserves the right to reject applications that do not meet eligibility criteria or technical requirements.

User Responsibilities

Accurate Information

Provide truthful, accurate, and complete information in all applications

Compliance with Laws

Ensure your website complies with all applicable South African laws and regulations

Account Security

Maintain confidentiality of your login credentials and immediately report unauthorized access

Technical Maintenance

Keep your technical information updated and notify of any changes requiring portal updates

Application Terms

Submission Process

All submitted applications become property of ISPA and ICASA for review purposes. Applications must meet all eligibility criteria and technical requirements outlined in the Application Guidelines.

Review Timeline

ISPA and ICASA reserve the right to request additional information and may take reasonable time to review applications. No guaranteed timeline for approval is provided.

Approval Authority

ICASA maintains exclusive authority to approve or reject applications. ISPA's role is technical administration and facilitation of the process.

Data & Content Rights

Technical Information

Website URLs, titles, organization names, and technical details are considered public information for approved zero-rated sites and may be displayed publicly.

Personal Data Protection

Personal contact information remains confidential and is used solely for application-related communications and regulatory compliance, as outlined in our Privacy Policy.

User Content

Users retain all rights to content submitted through applications. ISPA does not claim ownership of your website content or organizational information.

Limitations & Disclaimers

Service Availability

The portal is provided "as-is" without warranties. ISPA does not guarantee continuous availability or uninterrupted service.

Third-Party Services

The portal may reference or link to third-party services (e.g., DNS lookup tools). ISPA is not responsible for the accuracy or availability of such services.

Implementation Responsibility

ISPA facilitates applications but is not responsible for operator implementation of zero-rating. Implementation timelines and technical issues are handled by individual operators.

Termination

User Termination

You may terminate your account and discontinue using the portal at any time. ISPA reserves the right to suspend or terminate access for violations of these terms.

Effect of Termination

Upon termination, your right to use the portal ceases. ISPA may delete your account information, except as required by law or for legitimate business purposes.

Governing Law & Disputes

Applicable Law

These terms are governed by South African law, including the Electronic Communications and Transactions Act and Protection of Personal Information Act.

Dispute Resolution

Disputes arising from these terms shall be resolved through good faith negotiations. If unresolved, disputes may be referred to appropriate South African courts or alternative dispute resolution mechanisms.
